Q: Attorney Tully, are parole officers allowed to frisk or pat down people who are not on parole?
A: A recent Pennsylvania Superior Court decision allows it. An agent went to the home of a parolee to check on him. Another friend was there who was not on parole, but was acting suspiciously. When the non-parolee went to get his jacket the agent grabbed the jacket and frisked him. The agent found a gun in the jacket. The Court said since the agent had a reasonable suspicion that the person posed a safety risk, the pat down and frisk was OK. Call me for a FREE meeting.
