Q: Attorney Tully, the police came to my house to serve a warrant against me for assault. They knocked on my door one time, then busted into my house. They found drugs inside. Was that legal?

A: The Knock and Announce Rule in Pennsylvania prohibits police from just busting into your house. Before the police can enter your house to serve a warrant, they must identify themselves and tell you why they are there. The police must also give you a reasonable time to open your door before they force their way in. There are some exceptions to this rule but you should immediately file a Suppression Motion. Call me.
