Q: Attorney Tully, if there is wrong information on a search warrant or Affidavit of Probable Cause does that invalidate the warrant? Will all the charges be thrown out because of the errors?
A: Probably not. The Pennsylvania Superior Court has ruled recently on this issue. The Court held that some erroneous information in a warrant is not enough to suppress the evidence. Specifically, they held that misidentifying a person’s first name on the warrant or listing the wrong day of the week of the trash pull, for example, did not warrant throwing out the charges or invalidating the search warrant.
