Q: Attorney Tully, I was convicted of a crime years ago. I got probation for the offense. Can I own a gun now or am I barred from gun ownership because of my conviction?
A: You might be in luck. A Federal Appeals Court that covers Western Pennsylvania ruled recently that certain lesser crimes should not bar gun ownership by convicts. One of the factors the Court looked to was whether the Defendant served time for the crime they were convicted of. Since you got probation, that’s a plus in your favor. Each case is different, but call me to discuss your case. Thanks. Bernie
