Attorney Tully: Best Time to Consider Settlement – BEFORE or AFTER Lawsuit
Attorney Tully, should I engage in serious settlement discussions BEFORE a lawsuit is filed or AFTER. Both options have their advantages BUT:
If you try to settle your case BEFORE a lawsuit is filed there are certain advantages such as:
1) Costs will be less
2) Problems with the case can come out during the discovery phase
3) Receive settlement proceeds quicker
HOWEVER,
Not settling until AFTER the lawsuit is filed has in my experience proven to be more effective. Pushing the wrongdoer to the limits and then only seriously considering settlement discussions until you are “on the court house steps” usually gets the wrongdoers drop dead/top offer.
