If you have been the victim of a trucking accident should you immediately get an attorney or wait until your injuries have healed to seek counsel? This is an easy one and it really does sound self serving on my part. Of course you should immediately get an attorney if you are involved in a trucking accident case.
Okay, the big question is why. Simply put, it’s so you can level the playing field. Many trucking insurance policies have at least $1,000,000 in coverage. Insurance companies are not going to give up any part of that $1,000,000 without a fight. Therefore, they almost immediately get their army of investigators on the case. The investigators go to the scene of the collision and obtain evidence that is favorable to them. They will often talk to the police officer who investigated the accident. Finally, they secure statements from any witnesses to the accident.
While they are doing all this, the insurance adjuster will be contacting you, trying to get a recorded statement from you. Often times they try to use that statement against you by limiting the extent of your real injuries. If you tell them your back is only hurting you a little bit the day after the accident they use that as an anchor against you later on. We have had many clients who eventually required back surgery even though their back only hurt a little bit at the scene.
