A: Not anymore. Either you consent to the officer’s request or legally you are a refusal. The Pennsylvania Supreme Court just ruled on this issue last month. What the Pennsylvania High Court said was normally if the officer tells you to take a blood draw chemical test, you must do so or you are considered a refusal.
