Pennsylvania Supreme Court Allows Cruz’s Name To Be Placed On The Pennsylvania Ballot

Well, the Pennsylvania Supreme Court has spoken.

Recently there was a challenge to whether or not the name of United States Senator Ted Cruz, Republican from Texas, would be allowed on the April 26th Pennsylvania primary ballot.

A political group challenged his eligibility to be on the ballot.

The legal basis for the challenge was that Cruz is not a natural born citizen.

This issue has come up before.

Obviously politics is hugely involved in this litigation matter.

In our society, this is what happens when political issues arise. Someone must decide the legality of the political issue.

No politician could do so.

They are just too involved in the issue at hand.

Well, the Pennsylvania Supreme Court did decide.

The Pennsylvania High Court decided that Ted Cruz’s name will appear on the Pennsylvania primary ballot after all because Cruz is a natural born citizen.

Bernie Tully thinks one thing is clear from this decision.

That is, the Pennsylvania Supreme Court is not afraid to take on a controversial legal or political issue.

They will rule on anything that affects the Pennsylvania and United States Constitutions.

Legally nothing is more important to the democratic process than allowing a person to be on a primary ballot.

Now it is up to Pennsylvania citizens to decide who to vote for in this highly contested Republican primary.

But the Pennsylvania Supreme Court did a huge service to its citizens. They decided a big political issue in a legal way.

I guess that is what democracy is all about.

Again, this does not mean they are endorsing him as a Republican candidate.

It merely means that the Pennsylvania High Court is allowing him the opportunity to run for the Presidency in the state of Pennsylvania.

As a matter of fact, the Court does not look forward to making these types of rulings. Courts do everything they possibly can to avoid having to decide a political issue like whether a person’s name should be on the ballot in a primary.

But when they are directly confronted with a legal issue, the Courts will not back away from making a controversial call.

That is what they did here. And we are all better off for it.
