Q: Attorney Tully, anything new in DUI cases or license refusal cases?
A: Yes. The United States Supreme Court’s recent Birchfield v. North Dakota decision is a game changer in DUI license suspension cases. The Court ruled that if the police are going to draw blood from you to see if you are under the influence of alcohol, they must get a search warrant to do so. This does not apply in a case where you are given a breathalyzer. If you have such a license suspension case you should contact an attorney immediately to get the full benefits of the decision.
