Q: Attorney Tully, my son is going to be sentenced next month. I was reading about sentences like 11-1/2 to 23 months. Why aren’t sentences 1 to 2 years as opposed to 11-1/2 to 23 months?
A: A sentence of 11-1/2 to 23 months is a County sentence not a State sentence. Therefore, the sentencing Judge maintains control over the case. If the sentence is 1 to 2 years it becomes a State sentence. Then the Judge loses control over the possibility of early parole. A County sentence keeps the Judge in control of the case.
