WORKERS COMPENSATION AND YOUR UIM CLAIM
A client of ours was at work, in a company vehicle, when she was rear ended. Because she was working at the time, Workers Comp paid for her medical bills. The bills were enormous and exceeded the policy limits of the wrongdoer’s insurance. Can W.C. get reimbursed for the money they paid out? Yes, but they cannot get reimbursed for any money we received on her personal underinsurance policy. Fortunately, our client had the foresight to buy underinsurance coverage on her policy. Whew! The lesson for all of us is to buy underinsurance coverage on your auto insurance.
DEFENSE ADMITTING NEGLIGENCE VS ADMITTING LIABILITY
We were recently contacted by a defense attorney in an intersection collision who offered to stipulate to negligence, meaning that his client caused the accident. However, this is NOT the same as if he offered to stipulate to liability. Huh?? If the defense only offers to stipulate to negligence, they can still offer evidence that our client was over 50% at fault in causing the collision, meaning our client wouldn’t recover anything! Had they admitted to liability, the defense couldn’t argue comparative negligence! Can you see the difference?
WAGE LOSS ON YOUR AUTO POLICY
Many of our clients are seriously injured in auto accidents caused by a wrongdoer. They still need to work to make ends meet. Some folks believe that since they bought wage loss protection on their auto policy that payments will automatically be issued to them after the accident occurred. Not so. Until a doctor writes a slip saying you are disabled and can’t work, the insurance company won’t pay you a penny! Let us help you get through these issues and fight for you!
WHAT YOU DON’T KNOW CAN HURT YOU IN LAW: FILING A CLAIM AGAINST A GOVERNMENT AGENCY – NOTICE REQUIREMENT
If you are injured as a result of the negligence of a government agency, such as a township, municipality or state agency like PennDOT, in order to bring a lawsuit against the government, the injured party must provide the government agency NOTICE of intent to sue within 6 MONTHS of the accident date. If you fail to provide the government agency with the 6 month notice requirement, you may be precluded from going forward with your lawsuit. If you believe the government’s negligence caused your injuries, don’t wait until it is too late!

CONTINUING LEGAL EDUCATION AND LAWYERS
Each year, every attorney in Pennsylvania must take 12 hours of continuing legal education (CLE) classes to practice law in Pa. CLE’s are very helpful because that allow us to stay updated on the current laws in a variety of different legal areas. As an example, last week Michael took a 4 hour CLE on Premises (slip and fall cases) Liability.

Everyone is Irish on St. Patrick’s Day! Pittsburgh has a long tradition of celebrating this day due to the large Irish population in the area. Don’t forget to wear your green to keep the spirit of St. Patrick’s Day going!
