There are 3 ways insurance companies try to screw someone with a pedestrian injury out of money their money. There’s no rhyme or reason to these, but we hear it every day.
Not Paying Attention
The 1st thing they say is that the person with a pedestrian injury was not paying attention and that’s the real reason why they got hit by a car. They make them a double victim by saying they are the ones at fault for this. They try to spin it by stating, “If they were paying more attention, none of this would’ve happened”. Is this crazy or what? However, that’s what the insurance companies do because they want to lessen the value of injured pedestrian cases.
Not in the Crosswalk
2nd, insurance companies often say the person with the pedestrian injury was not in the crosswalk. If they were in the crosswalk, they are in a really good situation because the law says cars have to yield to you. Nonetheless, even if they weren’t in the crosswalk, that’s not the end of their case! There might not have been a crosswalk in the area or the driver could have not been paying attention because they were on their cell phone. If they hit the injured pedestrian and that’s what caused their back injury, well guess what? They’re still entitled to compensation!
Not Truthfully Hurt
The 3rd thing the insurance companies tell the person with the pedestrian injury is that they were not hurt. Even if they have records that show they were hurting, the insurance companies like to say, “Well, they didn’t go by ambulance when they left the scene”. That doesn’t matter. What does matter is that three hours later, they were driven to the emergency room by someone because the pain started later? With this, they will also bring up that the police report might say the person at the scene said the injured pedestrian wasn’t feeling that bad. What we try to argue is what any person’s normal reaction is when they fall or are hit by a car and are hurt. Typically, the person who gets hit, says they’re okay and try to brush it off.
