WHAT IS NEW IN THE TULLY FAMILY

Our daughter Jessica is getting married to her long-time soulmate Kevin Horne in August at State College. We cannot wait to celebrate this joyous day. Jessica is someone who immediately lights up a room with her smile. Her future husband, Kevin, is a fantastic caring man. Congratulations Kevin and Jessica on your forthcoming wedding!!

LEGAL: HOMEOWNERS NEXT TO GOLF COURSE AWARDED $5 MILLION BY JURY

A family with a house near a golf course, was awarded $5 million by a jury for damages they sustained! Like in any slip & fall case, a critical part of the case was the golf club had NOTICE the design of the golf course resulted in the family’s home being struck by over 600 golf balls over several years. Even though the golf club had notice of the problem, they did nothing to resolve it. The family sued claiming the golf club did not protect their home from a known danger which deprived them of their right to enjoy their property. In general, victims are in a great spot if a Defendant knows of a problem, but fails to act, and that failure results in damages to the victim.

GEICO ORDERED TO PAY $5.2 MILLION TO WOMAN INFECTED WITH STD

Geico was ordered to pay $5.2 million to a woman who was infected with an STD by Geico’s insured, while in the Geico insured vehicle. What?? Geico initially denied the claim and refused to enter a defense for their insured. The Court held that by Geico refusing to defend their insured, they waived any defense to liability in the case and was not allowed to re-litigate the issue after the large award was entered against Geico. Under most circumstances, your insurance company has an obligation to provide you with a defense, which Geico ignored to its detriment.

LEGAL EAGLE QUESTION

What state has the oldest Appellate Court in America? You guessed it – Pennsylvania. The Pennsylvania Supreme Court is over 300 years old! Think about that.

In a landmark civil rights moment, on July 2, 1964, President Lyndon B. Johnson signed the Civil Rights Act of 1964 into law that prohibits discrimination on the basis of race, color, religion, national origin or sex!
