What is bad faith insurance? It is when an insurer attempts to go back on its obligations to its clients. Typically, this happens either when they refuse to pay a policyholder’s legitimate claim or investigate and process a policyholder’s claim within a reasonable period.

So why do they do this? The reason is simple. In an injury case, you have specific damages and injuries that can be quantified. That is not the case with bad faith. In a bad faith claim, the sky is the limit. It is up to the jury to determine the value of the insurance company dealing with you in bad faith.

If you suspect bad faith from your insurance company, you should confront them insurance company or, better yet, connect with us! Your insurance company has a fiduciary duty to negotiate with you in good faith. If they do not act in good faith, they have breached that duty.

For example, suppose you receive the wrongdoer’s policy limits which are $15,000. We then make a claim for underinsurance from your insurance company to award you extra money. Suppose you had to have surgery and were off work. If they do not offer the extra month to you that is bad faith. And that is what insurance companies are afraid of.

We have experience using this method of going after your underinsurance policy and we are often able to get a significant amount of additional money if there is a factual basis to allege bad faith insurance. If you think you have this situation with your own insurance company for a car accident – Give us a call. We will talk to you about it. If we cannot help you, we will tell you.
