This is an important question and my short answer is it depends. It depends on if you should settle or go to court because the circumstances of every case are different; yours is no exception to that. Sometimes it’s better to file suit and to go for. Other times it’s better to settle the case up before filing a suit.
Should I Settle Or Go To Trial?
Something you need to ask yourself is, “Would I do better in front of a jury?” You have to weigh in the fact that the words insurance will never come up in a trial because you’re not allowed to say that or how much money the offer was on your case in Pennsylvania. This means the jury starts at ground zero.
Maybe you already have a $50,000 offer, but you think you can do better in front of a jury who doesn’t know you have an offer of $50,000 on a serious injury case? Sometimes people can do 10 times better, but unfortunately, that is not always the case. It’s also important to note that other costs start to accrue rather quickly once you filed a lawsuit. You have to also factor in the doctor’s deposition which can cost upwards of $3,000 to $5,000 for their one hour of testimony in their office.
