Q: Attorney Tully, can you bring a Wrongful Death case against someone for killing another person, as a result of a tragic accident? I mean does the death have to be intentional to bring a Wrongful Death claim?
A: No, intent is not required. Recently a California jury awarded $6.5 million to the estate of a man accidentally, but wrongfully, killed by a police officer. The officer had responded to a call of a man waiving a gun. The officer saw the victim with something in his hand and without any warning, shot the man 12 times.
