Q: Legally what is involved in going after a bar that serves a driver too much alcohol and then someone is killed by the drunk driver?
A: A dram shop case usually involves a bartender continuing to serve a person alcohol when the person is “visibly intoxicated”. If the person is falling down drunk, it’s a no brainer. But what about when the person is only showing some signs of intoxication, like slurred speech? Is that enough?
