A: Yes. In fact a recent Pennsylvania case addressed that very issue. The estate of a deceased woman sued the nursing home where their mom had stayed. The Court decided that chronic continuous under-staffing at a nursing home results in an inability to properly care for patients at the home. Also, under-staffing can lead to a punitive damage award. In that case, the jury awarded the estate about $500,000 mostly because of the under-staffing. When it is properly presented to a jury, the jury takes these matters very seriously.
