Q: Attorney Tully, I was rearended in an auto collision and had to have back surgery. I received an offer from the insurance company. How do you work your attorney fees if you are retained after the client has received an initial offer from the insurance company?
A: Very good question. I try to be fair about it. I recognize you received an offer on your own without my help. So I usually agree that my attorney fees are calculated after the offer you received. For example, if you have a $10,000 offer, my attorney fees will start after that $10,000 amount. That way you get the benefit of your efforts before I got involved in your case. We do surgery cases. No recovery/no fee.
