Q: Attorney Tully, if a person is seriously injured or killed on another’s property, isn’t the owner of the property automatically responsible?
A: It’s not that easy. The law only requires the property owner to take reasonable steps to protect people on their property. Remember the three former Duquesne University basketball players who were shot in 2008 after a school sponsored dance? A Federal Judge recently threw out the case against Duquesne University because the school provided security for the dance and that’s all it was required to do. The key here is reasonableness. If Duquesne had warnings of the threats before the dance and did nothing about them, that would have led to a different outcome.
