Q: Attorney Tully, I am charged with homicide by vehicle. The police are claiming I was speeding and that is what caused the death of a pedestrian. Can they use black box data from my car at trial?
A: The Court will probably admit evidence of your speed based upon any data from a black box. Technically the black box is called an Event Data Recorder (EDR). EDRs are much more reliable than a witness just saying you were going very fast prior to the collision. Recently a Pittsburgh Judge allowed a jury to hear similar evidence because it is scientific and objective in nature. Call me for a free meeting.
