A: Maybe. The Pennsylvania Wiretap Act makes it a felony of the 3rd degree to record someone’s conversation without their consent or knowledge. The Pennsylvania Superior Court in February of this year ruled that secretly recording a conversation on your I-Phone app is a violation of the Wiretap Act and is a crime. Surprisingly, the Wiretap Act provides an exception for telephones. But the Act was made law before I-Phones were common. Stay tuned on this one. Call me to discuss this issue. Bernie
