Q: Attorney Tully, if there is a long delay between the date of my conviction and when I am sentenced, is that grounds to have the case thrown out?
A: I would not bet the ranch on it. Last year the Pennsylvania Supreme Court determined that a delay of more than 17 years between a conviction and the imposition of the death sentence was not a violation of due process. You have to show legal prejudice in order to get relief. That’s a pretty high standard to prove as the Supreme Court case points out. Call me to schedule an appointment. Bernie
