1 Type of Injury Case We Do NOT Do…

 

It seems like I am always talking about the types of cases that our law firm handles. Auto accidents, slip and fall cases, Worker’s Comp. cases, products liability cases, wrongful death cases, medical malpractice cases, Social Security claims, passenger injury cases, pedestrian injury cases,uninsured and underinsured cases. The list goes on and on.

However there is 1 type of case which our law firm does not handle. That is infection cases developed while the patient is in the hospital.

Yes we do medical malpractice cases. We even do bed bug cases. But if you have a hospital infection claim we are NOT the law firm for you.

Why is that?

The answer is that hospital infection cases  are extremely difficult to prove.
In order to win a case like this, you need an expert to testify in their opinion the infection you received that is causing your ailment came directly from your hospital stay.

It is POSSIBLE that it did.

However the law requires that a jury conclude to a reasonable degree of medical certainty that the hospital caused your infection. That is a much higher standard of proof.
It is not enough that the infection began while you were in the hospital. It has to be that the infection came from the hospital.

Can I give you an example,? About 6 months ago I was at a medical malpractice seminar. Pittsburgh medical malpractice and infectious disease attorney Bernie Tully was there with about 50 other medical malpractice attorneys in the audience.
The guest speaker was a nationally renowned attorney on medical malpractice. He had a simple question of the audience.
He asked has anyone ever successfully either settled or won at trial a hospital  infection case?

I was shocked to see that not a single person who do malpractice cases raised their hand.

That shows you the incredible difficulty of winning an infectious disease case against the hospital. It can be done, but it is very difficult to accomplish.

It’s real important that your attorney knows what kind of cases they can help you with and which ones they cannot. But hospital infection cases are not one of them.
