Mother Of Man Killed By Rock-Crusher Receives $6.5 Million Settlement

The mother of a man who fell into a rock crusher and was killed has recently settled her lawsuit against a Pennsylvania quarry and the crusher manufacturer for $6.5 million. Adoption Agency Hit With $11 Million Verdict In Child Abuse Lawsuit

An adoption agency that sent a 5-year old girl to live with a couple who subjected her to sexual and physical abuse in their foster home has been hit with an $11 million verdict by a Pennsylvania jury. Legally, the duty of an adoption agency, when it places a child in a foster home, is to ensure that the child will be safe from sexual and physical abuse. This duty is continuing. What the adoption agency did, obviously, was to place the child and then forget about her with horrific results. The jury sent the appropriate message. Yes, we handle cases like this.

This Month’s Criminal Law Legal Eagle Question

Can a student who took a cell phone video of a fistfight between 2 students and then texted the video to 2 additional friends, be charged with disorderly conduct in Pennsylvania under the criminal statute? What do you think? The answer is NO! The Pennsylvania Superior Court recently ruled, because of the First Amendment, a criminal disorderly conduct charge cannot be maintained against a student merely videoing a fight at school. Agree?
