How Can YOU Benefit From Reading Our Newsletter? Just by reading about legal principles that can help you in the future. For instance, what is underinsurance? Underinsurance is extra insurance from your own auto insurance company to protect you financially. Sometimes the person who caused severe injuries to you or a loved one carries the state minimum amount of $15,000. Obviously that is not going to make you whole from your injuries caused by the collision. Therefore, you have the right to buy underinsurance from your insurance company at a very low cost.

The way it works is that if the wrong doer does not have enough coverage to make you whole, you can collect their insurance coverage limits. Then you can make an additional claim for underinsurance from your policy. What’s the good news about this? Under the law you cannot have your insurance rates raised because  of this claim to your company. We strongly suggest that you not only purchase the Full Tort Option but that you also buy underinsurance coverage. If you have any questions about this, please give me a call.

Are YOU A Legal Eagle? “You Be The Judge” Question 1 – Criminal: An out-of-court statement is hearsay and generally inadmissible in a trial. What about a hand written note from the victim saying “If something happens to me _____ did it”? It is still hearsay. But is it admissible at trial? Yes (Fitzpatrick case). The note was considered an exception to the hearsay rule.

Legal Eagle Question 2 – Workers Compensation: Is a Defendant working in the scope of his employment if he hits you with his car while on vacation, but after he went to his business to get his personal tools? The tools were for a home project. Answer: Sorry, Charlie, his employer is not on the hook for this one! (McDonald case)

Today’s Legal Question: Should you get an attorney involved in pursuing an injury case? You have the absolute right to try to get your accident case settled without an attorney. In some smaller cases, you may not even need an attorney. But there are dangers in doing this. For example, do you know sometimes you must first get a Waiver of Subrogation from your own insurance company before you can accept the wrongdoer’s offer? If you do not get it you can forfeit your right to make an underinsurance claim. That could cost you a lot of $$ if you have more than E.R. treatment!

From Our YouTube Videos – Does Home Therapy Increase The $$ Offer You Get From The Insurance Company? Sometimes clients tell me that because of their work schedule they just cannot get to physical therapy. Therefore they do home therapy exercises. I believe them. The question from clients is this. Are home exercises going to increase the value of my case? Or more importantly will the insurance company even consider them when making an offer? The short answer is probably not. Unfortunately insurance companies take a very skeptical view of home therapy treatments. They generally do not believe people do the home therapy exercises.

How can you maximize the value of your case? IF you are hurting it is very important that you get physical therapy or chiropractic treatment. This will help the value of your claim and more importantly help get you better. Call me for additional tips about increasing the $$ value of your claim.
