What is the difference between an adult getting injured in an auto accident and a minor hurt in an accident? A minor is anyone who is under 18 years old. I’ll tell you what I think the biggest reason why it is a little bit different for your child’s personal injury case than it is for an adult.
The 1st reason it’s different is because if a child is hurt in an auto accident and you settle your child’s personal injury case, you have to get court approval of the settlement. If you’re an adult and you settle the case, there is no requirement for getting court approval.
The 2nd reason why a miner’s case is different is because they are probably in a better legal position than an adult to get their claim settled. This is because usually there is no way the child is responsible for an accident. Regularly they are only the passenger in the car. So if the minor is the passenger, there is no way that they’re going to be the cause for the accident.
