January 2021

PERSONAL REFLECTIONS:

One of the greatest gifts of doing personal injury law for over 35 years is the incredible variety of people we represented. Maybe 10,000 clients in all. Recently I represented Reverend T. in an auto accident. The Reverend is of a different faith than mine (the heathen!) LOL. Last month I asked the Reverend what his weekly sermon was going to be about. I really listened to him. It was centered on God is the one allowing you to take your next breath. Now I periodically call Reverend T. and ask him about his weekly sermons. It has been a true blessing in my life. We are all brothers and sisters under God’s eternal love. Jesus, or whoever you believe God is, really loves us with all our faults! Thanks for listening. Bernie

THANK YOU ALL:

We wish to gratefully thank Bob R., Tommy R., Joyce C., Jan I. and Clarisa H. for their kind referrals. Referrals are what keep us going. We hope you continue to help us!

WHAT IS NEW AT THE TULLY LAW FIRM:

There are 3 new things at the Tully Law Firm as listed below.

Part 1 –With the latest orders from the Governor and health department, any work that can be completed from home should be done so in order to avoid physically going into the office. We have followed these pandemic recommendations and are rotating everyone so that only one person is in the office at a time. Even if we aren’t physically in the office, we still have access to your file, and everything on our computer system. We are here to help.

TULLY PART 2 – DOCTORS ABIILITY TO TESTIFY LIMITED TO THEIR AREA OF EXPERTISE:

We recently took the deposition of a doctor hired by the insurance company who previously examined our client in a defense medical exam. Our client had a knee injury, but the doctor’s qualifications listed her as an ankle reconstruction expert. When we asked the doctor whether she primarily treated ankle patients, rather than people with knee injuries, she got very defensive that we were questioning whether she was qualified to treat knee injuries. I think this will really help us in the event of a trial, when we point out that the doctor the defense is relying on isn’t even a specialist of the part of the body our client injured!

TULLY PART 3 – Michael Tully has been truly invaluable in helping me move cases! Thanks Michael for everything!

NEW YEARS RESOLUTION:

The start of the New Year is truly a great time to change/improve something in your life. Whatever your resolution is, I hope you stick with it. Take it day by day and don’t get down on yourself if you slip up.

NEW STATIONS’ TRAFFIC CAMERAS – CAN YOU GET THE VIDEOS:

When you are watching the news in the morning, there is always a traffic segment that switches to a live feed of the current conditions on the highways and roads. If you are in an accident in an area of the roadway that is being recorded, can you get the video from the news station? The answer is no! The Courts have determined that news stations are not required to turn over the tapes for purposes of a personal injury lawsuit! Your opinion?

DOES MIKE TOMLIN GET ENOUGH CREDIT FOR SUCCESS?

What are your thoughts? Is it just that he is overlooked because he is not Bill Belichick? His winning record crushes those of Chuck Noll and Bill Cowher. The Steelers winning another Super Bowl would sure give him his just due! GO STEELERS!

NHL RETURNS JANUARY 13, 2021:

It’s official, the NHL is returning on January 13, 2021 for a reduced 56-game season! However, there will be significant changes, with the Penguins being assigned to a new division, and the Pens will only play teams in its own division. This system was designed to reduce travel for away games. Let’s just hope Crosby and Malkin have another Stanley Cup run in them!

JOKE OF THE MONTH: Why can’t your nose be 12 inches long? Because then it would be a foot!

WORD ON THE MONTH: Paucity – Noun. Smallness of number or quantity. With the Covid-19 restrictions, only a paucity of fans are allowed to attend the Steelers games in-person.
