WHAT IS NEW AT THE TULLY LAW FIRM
1) New Cases And Off-Road Vehicles: – These vehicles are usually not allowed on the highway. But if you are riding these machines on the highway, you still have rights, and we may be able to pursue a claim for you. No one has the right to rearend you just because you were on the roadway with an Off-Road or ATV vehicle. Over the last 9 months, we have had 4 such claims and were able to get a substantial recovery in each one of them. One claim involved a victim who was killed while briefly operating his Off-Road vechicle on the roadway. Another victim was killed by a UPS vehicle. Please give us a call if you, or someone you know, has been involved in a serious ATV or Off-Road Vehicle accident.
2) It’s official! All members of our staff including Mary, Denise and Pam have received their second Covid-19 vaccine shot and are now fully vaccinated. We will be working full time back at the office starting May 3, 2021! Sorry staff. LOL
PREPARING FOR YOUR DEPOSITION
For many clients, one of the scariest parts of a lawsuit is that they will be deposed by the insurance company’s defense attorney. A deposition is a question and answer session that is taken under oath. Although preparing for your deposition may be tedious, all you have to remember is the golden rule – just tell the truth. The reason for this is that if you are caught in a lie about how the accident occurred, or the extent of your accident-related injuries, it will torpedo your case. We always prepare our clients before their depositions to help them through the 4 stages of a deposition 1) Your background, 2)How the accident occurred, 3)Your injuries and course of treatment, and 4) How you are feeling right now. Depositions are routine. Michael just did one today. It went great because our client was fully prepared.
PENNSYLVANIA ASSIGNED CLAIMS PLAN
What happens if you are involved in a motor vehicle accident and the driver that caused the accident doesn’t have insurance? Normally you would pursue an uninsured motorist (UM) claim through your own auto insurance company. But if that isn’t available to you, are you out of luck? No. The Pennsylvania Assigned Claims Plan is a statutorily created safety net fund intended to be a source of last relief for drivers injured in a motor vehicle accident when there is no insurance available. The fund only provides a maximum recovery of $15,000 including medical bills. It isn’t much, but at least it is something! See what you can learn through our Newsletter! LOL
RECORDING WITHOUT CONSENT – IS IT ADMISSIBLE?
Under Pennsylvania law, the answer is NO! Pennsylvania is a two-party consent state – meaning that both parties must have knowledge that they are being recorded and agree to their conversation being recorded. In a recent case, an insurance adjuster recorded a client’s statement without informing the client that the conversation was being recorded. Later, when the defense attorney attempted to admit into evidence the recorded statement, the Judge declared it was inadmissible because our client wasn’t informed, and didn’t consent to the conversation being recorded. That was a great result for us and our client!
PENGUINS HEADED TOWARD THE PLAYOFFS
Once again, the Pittsburgh Penguins are headed back to the Stanley Cup playoffs. As our star players Sidney Crosby and Evgeni Malkin age, this season might be the last realistic chance we have to win another championship with these great players. No matter what happens, this has been a heck of a run by this duo. Go Pens!

What are your thoughts on the contract extension for Coach Tomlin? I think we are lucky to have him. Let’s hope the Steelers can win the Super Bowl under Coach Tomlin this year.
