Certain states, including Idaho and Wyoming, do not require coverage of workers who are undocumented. In the southwest, Arizona, California, and Texas include undocumented immigrant workers in workers’ compensation coverage.
Depending on the state, certain workers may not be covered by workers’ compensation requirements. Some examples are listed below:

- Undocumented workers
- Domestic workers (housekeepers, nannies, babysitters)
If you are eligible for workers’ compensation, you can file a claim for benefits. However, you aren’t entitled to sue your employer for those same injuries in court.
