NOTICE ISSUE: DAYS INN AGREES TO PAY $24 MILLION TO SETTLE SEX TRAFFICKING CLAIMS

We often say an important element in making a claim against a defendant is showing they had NOTICE of the condition and did not do anything about it. This applies, for example, to stores, like Target or WalMart, who know there is a defect in their flooring and choose to do nothing about it. Then someone is hurt and the defendant becomes liable. In the Days Inn case there was a lot of evidence they knew that some of their rooms were being used to traffic sex and drugs. Instead of stepping in to stop this, they chose to look the other way to make money. Thus the $24 million settlement.

We have a similar notice issue in several claims against Airbnb. There is documented proof what the Airbnb companies did in Pennsylvania. They blindly rent places to people so they can do whatever they want to do, including having wild parties and allowing weapons and drugs on the property. Many people have been injured and even killed because of their policy. We are pursuing those injury claims. Why? Because of a huge increase of thefts of those vehicles. State Farm and Progressive are choosing not to insure these vehicles because the likelihood is much greater that a Kia or Hyundai will be broken into than other cars. Thus the companies will have to pay out an excessive amount of money in theft claims. Do you still think the insurance companies are on our side?

JURY AWARDS $4.1 MILLION IN LONG PENDING CAR CRASH SUIT

Does a long lapse of time from an auto collision until when it is heard by a jury make a difference? Many believe that is the case because the jury is likely to think it happened so long ago so who cares? However, in this Pennsylvania case the jury made an award of $4.1 million to the victim of a car crash even though a very long time passed from the accident until the final verdict. No one can really know what a jury makes their decision on. That is the scary part of trials for many people.

GIVE RADAR TO LOCAL POLICE?

This issue has been brought up before in our Newsletters. The Pennsylvania legislature is again attempting to allow local police departments to use radar for speeding enforcement. Pennsylvania is the only state in the country that prohibits local law enforcement from using radar. The State Police are allowed to use radar but not local police departments. The fear is local municipalities will use radar to write excessive tickets to raise government revenue. Should Pennsylvania continue to be the only state that does not allow radar for its local police?

GROUNDHOG DAY

The real significance of Groundhog Day is it is exactly the half way point of winter. As you are aware, this year Punxsutawney Phil did see his shadow. Guess what that means? Six more weeks of winter! But if we are being fair, this has been a remarkably mild winter in Pennsylvania so far.
