Truck/Auto Accident: Jury Awards $3.8 Million To Family Of Decedent

A jury awarded $3.8 million to the family of a victim whose car was pushed by a tractor trailer over a jersey barrier and then was struck head-on by another speeding truck coming from the opposite direction. In this wrongful death case it was easy to see that the force of the first truck that struck the decedent’s car was so great that it caused the car to become airborne and suffer the fatal tragedy.

Paralyzed College Student’s 20 Foot Fall Settles For $11 Million

A University of Pennsylvania college student was paralyzed after she fell 20 feet thru a skylight. She recently settled her case for $11.6 million. The victim fell thru a raised skylight opening on the fourth floor of an off-campus house. The victim sat on a piece of flex-board covering the skylight and fell thru the skylight. She landed on her tailbone and eventually fell on her head. The Defendant’s conduct was considered reckless because they covered the skylight with only a piece of flex-board and did nothing to repair the hazardous condition where the skylight was situated.
Man Paralyzed In Fall From Scaffolding Settles for $6.5 Million

In this case a scaffold that the victim was working on did not have guardrails despite recommendations that guardrails should be on the scaffolding. A joist that another worker had rigged broke and landed on the victim’s harness strap, pulling him off the scaffold and onto the floor, causing permanent paralysis. Our law firm has also handled many scaffolding cases for victims in the past 25 years.
Criminal Law Update/Conflict of Interest: Penn State University Case

Former University President Graham Spanier, Vice President Gary Schultz and former Athletic Director Tim Curley have been charged with lying and perjury based on their Grand Jury testimony.
Were they misled into believing attorney Cynthia Baldwin was representing them in front of the Grand Jury when in fact her role was as the attorney for Penn State? The case may hinge on whether their testimony is thrown out based on this alleged conflict of interest. I will keep you updated.
9/11 Attack & Saudi Arabia

Saudi Arabia can legally be named as a Defendant in a lawsuit filed by thousands of victims impacted by the terrorist attack of September 11, 2001. Saudi Arabia had tried to get out of the lawsuit by claiming sovereign immunity but the Court said no go.
Health Law Update: Germs – Clean Office Blues

In order to avoid catching a cold at work try to clean off the handles of faucets in the bathroom and microwave handles in the break room. A study found that 75% of the faucet handles in the bathroom and 48% of the microwave door handles had very high concentrations of germs where colds can start and spread.

New Criminal Law: No Need To Appear In Court?

The Pennsylvania Supreme Court has ruled that a child’s video-taped testimony outside of Court is admissible as evidence. The four year old’s video-taped statement that her father sexually abused her is now admissible in his trial. The child’s testimony was captured on a DVD interview with a New York police officer without the opportunity for the Defense to cross-examine the girl.
