One of the biggest fears many injury victims have is the fear of having to go to trial. This applies even if it’s a case they will obviously win. Still, the thought of taking it to a courtroom with twelve people you don’t know judging you can be very overwhelming. It’s a challenging situation for most people and most people don’t want to do it.
In the 40 years I’ve been trying cases, I can count on one hand how many clients have said, “Let’s go to trial!” This is so rare to hear and sometimes, unfortunately, it doesn’t end up the way they hoped. A majority of people want to settle their case, but there’s no guarantee that the case will be settled. More importantly, there’s no guarantee we’ll settle for a fair number.
That aside, I wanted to give you some reassuring statistics and information I read recently regarding lawsuits and injury claims. If you don’t want to go to trial 97% of all claims filed ultimately result in a settlement. For most people, a settlement is the route to go because it’s guaranteed money. A jury isn’t going to decide whether you get a penny or not.
Now once in a while, an offer can be so low that we strongly encourage our clients to go to trial. Nonetheless, normally if the client wants to try to settle it, and we can get them a good offer, we tell them what the offer is and they want to settle it.
